The U.S. Court of Appeals for the Second Circuit has accepted my client's position. In cases where the petitioning parent originally consented to the child's stay outside its habitual residence, wrongful retention occurs on the date that the petitioning parent is informed that the other parent will not return the child to its country of habitual residence.
